Monroe Attorneys Suceed in Removing Man from Sex Offender Registry
The man did not have any sexual or felony conviction, but ended up on the registry as a result of having consensual sex with someone under the age of consent when he was young.
Monroe attorneys Crawford and Boyle reported that last week their law offices were successful in getting the name of a Barrow County man removed from the sex offender registry. Although attempts to do so are not uncommon, the difference in this case was that the man had ended up on the registry despite never having been convicted of any sexual or felony offense. According to a newsletter from the law firm, their client ended up on the registry as a result of a decision he made when he was young to have sex with someone under the age of consent.
“While she was fine with it, her mother was not, resulting in charges being brought,” the newsletter reads. “The client used first offender provisions to keep the charge from becoming a conviction; however, due to an unexpected wrinkle in the law, he was required to register as a sex offender for the next decade and a half, even though his case had been discharged (dismissed).”
Crawford and Boyle report that they petitioned the Barrow County Superior Court and last week a judge agreed, signing an order that removed their client from the registry. The Georgia Bureau of Investigations then removed the man’s name from the registry.
“This was certainly a victory over cookie-cutter / one-size-fits-all "justice,” the attorneys claim.
Do you think the law is correct as it stands because it requires petitioning on a case-by-case basis? Or is it too broad and requires refining to ensure that cases like this don’t get mixed in with serious sex offenders?

I believe there should be an end to the punishment these people face in circumstances such as these. Often times the registry is a life sentence for young foolish behavior and diminishes the seriousness of true sex crimes. The money spent in monitoring these people who are not a threat could be used to track real offenders.

I tend to agree with you there Cathie. There are serious predators out there who need to be tracked. To dilute the resources to do so on people who might have made some unwise decisions, but did not prey on children or other victims, seems counter productive.

We do not believe in a public accessible registry for anybody, it should be offline and used by police, like normal criminal records are. It's nothing more than an online shaming hit-list, and there are tons of examples of vigilantism, here:

People should be allowed to get off the list after XX years without having to waste more of their hard earned money to hire a lawyer to petition the court, and even then it's not guaranteed. If we must have an online registry for one group of ex-criminals, then we should have one for all criminals:

There appears to be more to this story than is being reported here. From what I've been told by folks that work there, it is well known that he was caught in a relationship with one of his staff members, and as a result he is leaving the job as principal.
